AN EMPLOYMENT TRIBUNAL has ruled that former Pembrey Ski Centre manager Eirian Morris was unfairly dismissed by Carmarthenshire County Council.
However, while the Tribunal has upheld the unfair dismissal claim it rejected Mr Morris’s claim that he was dismissed as a result of whistle-blowing.
Mr Morris had claimed that he was pre-selected for redundancy as a result of allegations of dishonesty and sharp practice he made against a number of council employees.
The Tribunal observed that although Mr Morris had not provided more than anecdotal evidence of misconduct at Pembrey, the local authority had taken the allegations seriously and had investigated them.
Mr Morris’s allegations led to a review which uncovered chaotic management at Pembrey Country Park.
While the Tribunal rejected the claim that Mr Morris’s whistle-blowing had led to his dismissal, the Tribunal found that the process leading to his dismissal was unfair and made swingeing criticisms of the way the Council had conducted the process which led to Mr Morris’s redundancy.
It added that had Mr Morris been subject to a fair procedure, there was a 50% chance he would have been dismissed in any event.
